Many crimes fall under the category of sex crimes. Many scholars
exclude sexual assault and rape from this category, either
because it is its own species of offense, or because it is a crime
of violence. Sex crimes generally fall within two categories:
prostitution and sexual abuse involving minors.
Prostitution cases vary depending on who gets arrested. There
is usually a very different investigative processes involved when
the law enforcement agency goes after the prostitutes rather than
the "Johns." Yet, both may involve an undercover sting operation
or simple drive by patrols. There is what may be termed "The
Hooker Decoy Bust Operation" employed often by the San
Francisco Police Department and made famous in an A & E
Documentary. Other cases may involve officers posing as
escorts using faked on-line profiles to lure potential Johns into
being arrested.
The so-called "Solicitation of Prostitution" case usually rests on
an audio or video tape where the negotiations for services may
be recorded. The quality of the tape may vary, and where the tape
is inaudible, the case has a good chance to win. These cases
are not the most aggressively prosecuted cases and there are
many alternatives to incarceration in most counties.
More recently, there is a growing number of investigative
branches of the District Attorney's office and police agencies that
post faked on-line profiles in open internet communities like
Craigslist.org to lure suspected pedophiles, or will respond to
suspected pedophile listings.
Prosecutors are very careful when it comes to these types of
cases, and the District Attorneys who handle cases involving
children tend to be among the best, most aggressive attorneys
around. Nothing arouses the passions and hatred of society
more than accusations involving harm to our nation's children.
It behooves the potential client to hold fast to the presumption of
innocence when accused of such charges, and to hire a defense
attorney who is equally talented, careful and aggressive as the
opposition.
