Assault and Battery cases are a species of crime that can be
charged either as a misdemeanor or a felony. Many of these
charges are known as "wobblers."
Because the prosecutor has the discretion to charge an arguably
misdemeanor offense as a felony, many cases are overcharged.
Prosecutors in Santa Clara County, San Mateo County, Marin
County and Contra Costa County will often add numerous
enhancements to the felony charges as well. These
enhancements usually are called "great bodily injury" and/or
"dangerous or deadly weapon" conduct enhancements. An
"enhancement" is a term of art that means: were the defendant to
be convicted of the base offense and the jury were to find the
enhancement true, then one or more years would be added to the
sentence.
Prosecutors are very successful using this strategy of
overcharging and adding enhancements to ensure that the
defendant will plead guilty to some lesser offense or to the
present offense at a reduced sentence (usually county jail
instead of state prison).
It is in this exact circumstance where hiring an experienced trial
attorney can and will be the difference between success and
incarceration. If the prosecutor knows the defense attorney to be
a plea bargainer, then he or she will have no incentive to reduce
charges or dismiss the case.
